Ensuring product authenticity and quality
It’s essential for Merchants to follow BettaMall’s standards for product quality and authenticity.
Types of Violations:
BettaMall enforces Merchants who fail to comply with our selling standards. Violations related to product authenticity are classified as intellectual property violations. On the other hand, discrepancies in product quality or description are considered product condition violations.
(i) Intellectual property violations
BettaMall prioritizes the intellectual property rights of others. Merchants must be responsible for ensuring that the products you offer comply with all applicable laws and regulations. Additionally, these products must be authorized for sale or resale and must not violate intellectual property rights, such as copyrights, patents, trademarks, or rights of publicity. (ii) Product condition violations
The product you list on BettaMall and deliver to customers must completely match the description, images and all details provided on the product page. Items must reach the buyer in the condition stated, free from any damages or defects.
For products with expiration dates, the item must be properly labeled in accordance with applicable laws. Moreover, it must arrive to customers with sufficient time to use before it expires.
Here are some examples of product condition violations that you can note:
- Shipping a “new” product that arrives used, opened, or damages
Items described in “new” condition must arrive unopened, in good condition without any signs of previous use or damages. Buyers have rights to perceive a product as used if it has been opened, bears evidence of previous use, or displays physical imperfections.
- Shipping a product that is not similar to the listing description
This includes the variances in the information related to color, pattern, size, quantity, or even sending the completely wrong item altogether. The product’s language, version, model or edition must align with the details on the product page.
- Shipping damaged, defective, misclassified, misrepresented, or incomplete products
Products must function exactly as described and meet customers’ reasonable expectations. Missing parts, malfunctions or misrepresentation may lead to violation.
Merchants should regularly review and update their listings to ensure products are accurately described. For more details, check Merchant Code of Conduct.
Enforcement
Merchants must ensure that the products sold are consistent with the advertised content and must not use the name, logo, or trademark of any brand in any form of counterfeit or imitation intended to mislead customers. Depending on the severity of the sales policy violation, BettaMall may impose one or more of the following measures:
- A fine of $5 for each order generated from the violating product and immediate removal of the product at the time of detection
- Restriction, suspension, or blocking of product listings and sales activities
- Withholding of due payments
In addition, certain brands, products, or categories may have listing restrictions. Merchants must obtain approval before listing under these restricted brands, items, or categories. Failure to obtain the necessary approvals may result in the enforcement actions described above.
In particular, if false or misleading advertising is detected, BettaMall will withhold all payouts for a period of 7–30 business days in order to assess and address damages related to disputes. The Merchants shall be fully responsible for covering all costs arising from disputes caused by false advertising. In the event of major disputes, the withholding period may be extended indefinitely until all damages have been fully resolved.
