Responsible for taxes

Merchants are responsible for determining, declaring, remitting and reporting all applicable taxes in accordance with the applicable law for their business activities on BettaMall. This includes but not limited to: 

  • Income tax/ Corporate tax: Merchants must declare and pay income tax on their earnings generated from their sales on BettaMall. 
  • Value added tax (VAT) or goods and services tax (GST): Depending on the state, country or jurisdiction, Merchants are responsible for assessing and complying with VAT/ GST obligations. 
  • Sales tax/ Excise tax: When required by law, Merchants must collect and remit such taxes to the relevant authorities. 

In cases where required by law, BettaMall shall have the right and obligation to withhold, collect, and remit applicable taxes to the U.S. Government on behalf of the Merchants. However, such withholding and remittance by BettaMall shall not exempt the Merchants from their ultimate responsibility to comply with and fully satisfy all tax obligations as prescribed by law.

Taxes on Fees and Payments

All fees payable by the Merchants to BettaMall under this Agreement are exclusive of any applicable taxes. The merchant is responsible for paying any taxes that are imposed and payable on such fees (including, but not limited to, VAT, GST, service taxes, or withholding taxes as required by law).

All payments made by the merchant to BettaMall must be made in full, without any deduction or withholding for taxes or other charges (including but not limited to cross-border withholding taxes). If any deduction or withholding of tax is required by law, the Merchants must pay such additional amounts as necessary to ensure that the net amount received by BettaMall is equal to the amount due and payable under this Agreement.

International shipping taxes

When fulfilling an order across borders, the merchant is considered the exporter in the country of origin, and the buyer is considered the importer in the destination country. The merchant is responsible for any applicable export duties, taxes, or customs fees, while the buyer is responsible for all applicable import duties, VAT/GST, and customs fees related to their purchase. Any Customs Fees paid by either party, if applicable, are separate from and in addition to the product price and shipping costs collected on BettaMall.

BettaMall provides the platform for cross-border transactions but does not calculate, collect, or remit international taxes or customs fees on behalf of Merchants or Buyers. Merchants are responsible for ensuring that their product listings are accurate and comply with international trade and tax regulations. Buyers are responsible for reviewing and complying with the applicable import regulations in their country
