Product Prohibition/ Regime Policy

Applicability

This product prohibition/regime policy applies to all Merchants on the BettaMall platform.

Scope of the application

This policy governs the listing and sale of products, goods, and services on the BettaMall Platform.When listing a product, Merchants are responsible for their items to comply with applicable laws and not to violate BettaMall’s Conditions of Use and Policies. Please carefully review the following guidelines regarding the Restricted/Prohibited Product Policy on BettaMall.

The list of restricted or prohibited items may change based on actual circumstances. Merchants should regularly check for updates to ensure their products do not violate BettaMall policies.

Violations and Remedies

If Merchants list and sell a product that violates the law or any Bettmall’s policies, including those listed in the Product Prohibition/ Regime pages, they have to face certain sanctions. BettaMall will take appropriate corrective actions to protect customer safety and ensure compliance. 

Enforcement Measures for Violations:

• Any prohibited product identified will be immediately removed at the time of detection.
• Merchants will be subject to a penalty of $5 for each sale related to the prohibited product.
• In cases of serious or repeated violations, BettaMall reserves the right to apply additional measures, including but not limited to:
  • full refunds
  • restricted account access
  • permanent suspension of the seller’s account.

List of prohibited/ restricted products

If you intend to sell alcohol or alcohol-related products on BettaMall, you must comply with all applicable laws and BettaMall’s internal policies.

1. Alcohol

Alcohol and alcohol-related products are strictly prohibited on BettaMall, including but not limited to:

• Alcoholic or non-alcoholic beverages above 0.0% ABV, unless sold by pre-approved Merchants.
• Distillation kits or equipment marketed for alcohol production (e.g., beer, wine, spirits).
• Liquor licenses or permits.
• Any product marketed as age-restricted (21+).
• Products containing or encapsulating raw alcohol.

BettaMall reserves the right to reject or remove alcohol-related listings at its sole discretion.

2. Animals and Animal-related products

If you intend to sell animal or animal-related products on BettaMall, you must comply with all applicable laws and regulations, including requirements for licenses or permits where necessary. Merchants are responsible for ensuring compliance and may face legal or platform sanctions in cases of violation. 

Note: Prescription pet medications are strictly regulated and may only be sold by licensed pet pharmacies with a valid veterinary prescription.

BettaMall prohibits the sale of animals and animal-related products that are illegal, unsafe, or violate international, federal, or local regulations. This includes, but is not limited to:

• Live animals (other than insects, fish, shellfish, and crustaceans).
• Endangered, threatened, or protected species under the Endangered Species Act, the Lacey Act, or CITES, and any parts, eggs, or offspring of such species (e.g., tiger, leopard, elephant, sea turtle, pangolin, polar bear).
• Animal parts or products from cats, dogs, bears, mountain lions, seals, sea lions, and other restricted species.
• Products containing ivory, shark fins, shark cartilage, whale meat, or other derivatives of marine mammals.
• Illegal wildlife products or products taken in violation of applicable laws.
• Unlicensed or unregistered pet food, veterinary drugs, vaccines, or medical products.
• Animal feces, inedible or edible bird’s nest products without proper import permits, and insects classified as plant pests.
• Tools or kits for inhumane procedures (e.g., ear cropping, tail docking, declawing).
• Fur products that are prohibited under applicable laws, including those made from mink, fox, otter, or rabbit, except where exemptions apply (such as taxidermy, used fur, or traditional cultural purposes).

3. Fine Art

Accurate and transparent listing is essential when selling fine art on BettaMall. Clear product data not only helps customers make informed decisions but also enhances the discoverability of authentic artworks. 

The following types of art may not be listed:

• Three-dimensional works such as sculptures.
• Textile, anthropological, or archaeological-based art (e.g., Navajo blankets, cultural textiles).
• Artwork without a named artist or mass-produced commercial pieces, even if hand-painted.
• Reproductions of existing works unless deliberately created in multiple versions by the original artist.
• Giclée prints on canvas, promotional posters, advertisements.
• Editions over 200, estate-signed or plate-signed works, or Creative Commons editions.
• Open editions, even if signed.
• Art-related products that are not original artworks (e.g., books, posters, merchandise).

4. Automotive and powersports: 

BettaMall does not permit the sale of motor vehicles that are required to be registered. However, Merchants may generally list automotive parts, accessories, and powersports products that fully comply with applicable laws and regulations, including the Federal Motor Vehicle Safety Standards (FMVSS) and the Clean Air Act. Clear and accurate product data is required to ensure compliance and protect customer safety.

The following automotive and powersports products may be prohibited: 

• Motor vehicles requiring registration (unless permitted under BettaMall’s dedicated Auto storefront program).
• Emission control system defeat devices, such as delete kits, delete tuners, EGR block-off plates, throttle valve delete kits, and oxygen sensor simulators.
• Products altering or disabling on-board diagnostic systems or safety features.
• Used tires, wheels, or wheel accessories.
• Airbags, airbag components, and seat belt components.
• HID and LED headlamp conversion kits not compliant with FMVSS.
• Products designed to interfere with law enforcement, traffic signals, odometers, or vehicle safety features (e.g., GPS jammers, license plate blockers, autopilot bypass devices).
• Non-compliant safety equipment, such as helmets not meeting FMVSS 218 or lamps not meeting FMVSS 108.
• Engine coolant or antifreeze with more than 10% ethylene glycol and without bittering agent.
• Portable fuel containers not EPA-certified.
• Government-issued identification documents, license plates, or VIN plates.
• Car seat heating pads powered by vehicle or external batteries.

Additionally, certain products may be subject to additional state or local regulations. Merchants must ensure compliance with all applicable jurisdictional laws, including but not limited to:

• Brake pads not certified for state laws regulating copper, asbestos, or heavy metals.
• Wheel weights containing lead.
• In California: engines, aftermarket, performance, and add-on parts, as well as gas cans not compliant with California Air Resources Board (CARB) requirements.
• Lead-acid batteries are subject to state-specific retail restrictions.
• In Colorado, Maine, and New York: aftermarket catalytic converters not CARB-compliant.

5. Composite wood products

Products made with hardwood plywood, medium-density fiberboard (including thin-MDF), or particleboard are regulated by the U.S. Environmental Protection Agency (EPA). 

Any item that fails to meet EPA formaldehyde emissions standards or that is not individually labeled in accordance with EPA requirements is strictly prohibited from being listed.

6. Cosmetics, skin and hair care

Cosmetics are substances intended to be applied to the human body by rubbing, pouring, sprinkling, or spraying for the purposes of cleansing, enhancing beauty, or altering appearance. This category encompasses skin care products such as: creams, lotions, powders, and sprays, along with items like perfumes, lipsticks, nail polishes, temporary tattoos, facial and eye makeup, shampoos, hair dyes, toothpastes, and deodorants.

BettaMall strictly prohibits the sale of the following cosmetic products which do not meet compliance requirements: 

• Any cosmetic identified in FDA warning letters as misbranded or adulterated
• Professional hair-smoothing treatment: Brazilian Blowout Acai
• Prescription or cosmetic contact lenses
• Latisse
• Obagi products, including:
  • Obagi C Therapy Night Cream
  • Obagi Elastiderm Decolletage Skin Lightening Complex
  • Obagi Nu-Derm Blender
  • Obagi Nu-Derm Clear
  • Obagi Nu-Derm Sunfader
  • Obagi RX System Clarifying Serum
• MOOYAM TCA 50%
• High-concentration chemical peels

7. CPAP Cleaning and Disinfecting Devices

Medical devices in the United States are regulated by the Food and Drug Administration (FDA), which ensures that such products are safe and effective for human use. This regulation also applies to continuous positive airway pressure (CPAP) cleaning and disinfecting devices.

Currently, two primary types of CPAP cleaning devices exist:

• Devices that use ozone gas
• Devices that use ultraviolet (UV) light

However, the FDA has not approved or cleared either type of device for CPAP cleaning. Therefore, these products are considered unapproved medical devices.

As such, Class I and Class II non-exempt medical devices must be cleared by the FDA before they can be marketed in the U.S. Only devices that fully comply with FDA regulations and receive proper authorization are permitted for sale on BettaMall.

8. Currency, Coins, Cash Equivalents, and Gift Cards 

The following items are strictly prohibited from sale on BettaMall:

• Legal tender that has been altered outside of numismatic preservation (holograms, overlays, cladding, plating, colorizing,…).
• Paper money of any kind, including uncut sheets, bank notes, money orders, bricks, and certificates.
• Imitation currency such as coins, tokens, paper money, commemorative medals, and rounds made primarily of precious metal.
• “Unsearched” bags, rolls, tubes, jars, or hoards where Buyers cannot clearly identify the items they will receive.
• Counterfeit coins and paper money, including bank notes, bonds, money orders, silver certificates, and gold certificates.
• Stocks and securities.
• Equipment designed to produce counterfeit items.
• Cash or cash-equivalent instruments, including money orders, customizable checks (blank checks), traveler’s checks, stored-value products, and electronic redemption codes (except retail gift cards sold by pre-approved Merchants).
• Gift cards, including:
  • All non-approved gift cards
  • Retail gift cards exceeding $2,000 in value
• Non-monetized bullion (precious metals valued only by weight/content, not form).
• State or federal assistance benefits, including:
  • WIC benefits (e.g., infant formula, cash-value vouchers, food instruments, EBT cards, coupons)
  • SNAP benefits and SNAP EBT cards

9. Explosives, weapons and other related items

(i) BettaMall strictly prohibits the sale of all firearms, including: 

• All functional firearms (assault weapons, rifles, shotguns, handguns, muzzleloaders, black powder guns, starter guns).
• 3D-printed guns and 3D gun blueprints.
• Antique and collectible guns.
• Automatic weapons (machine guns).
• Concealed or disguised firearms 
• Electronic guns.
• Replicas manufactured after 1898 that can fire fixed ammunition.
• Non-firing replicas made after 1898 without federally required markings.
• Toy or imitation firearms without required safety indicators 

(ii) All parts, kits, ammunition, components and accessories for firearms, including but not limited to:

• Conversion kits & auto sears (machine gun conversion kits, drop-in auto sears)
• Gun parts (barrels, grips, frames, receivers, firing pins, triggers, internal components)
• Magazines & loaders (magazine extensions, couplers, clamps, high-capacity loaders)
• Stocks & braces (folding, telescoping, collapsible stocks; stabilizing braces)
• Silencers & suppressors (including mock/fake, or marketed for airsoft/paintball)
• Specialized tools & kits (AR/M16 tools, jig kits, trigger activators, bump-fire devices, slide fire stocks)
• Other accessories (bayonet mounts, sling plates, muzzle brakes, solvent traps, camouflage gun containers, rail systems, charging handles, gas blocks)
• Firearm production machinery and any equipment for manufacturing guns.

(iii) The sale or listing of explosive devices and any products containing explosive materials is strictly prohibited, including but not limited to:

• Fireworks.
• Flares, flare launchers, flare guns, and flare gun receivers.
• Grenades and grenade launchers (including military practice grenades, rifle grenades, smoke grenades, and metal replica grenades that could be mistaken for real).
• Improvised explosive devices (IEDs), related training aids, accessories, and certain explosive precursors.
• Mines.
• Projectile or concussive products that use gunpowder or explosive charges.
• Products containing explosive materials or blasting agents are prohibited by law 

(iv) BettaMall prohibits the sale of dangerous or disguised knives, including:

• Automatic / switchblade knives
• Balisong (butterfly) knives, including training versions
• Concealed swords (cane-swords, shobi-zue, swordsticks)
• Gravity or spring-loaded knives
• Knives disguised as harmless items (belt buckles, combs, hairbrushes, pens, lipsticks, air gauges)
• Knuckle knives and push daggers (punch knives, T-handled daggers)
• Stiletto knives
• Throwing stars / cards (ninja stars, cyclone knives, batman symbols, shirken, kung fu stars)
• Other combat or illegal blades (pilum ballistic knives, cockfighting blades).

(v) Additional products: BettaMall prohibits the sale of:

• Body armor and products with armor plates (bulletproof helmets, ballistic clothing)
• Caltrops
• Martial arts weapons, including:
  • Brass/metal/plastic knuckles, spiked keychains, striking rings
  • Leaded canes, staffs, crutches, sticks
  • Nunchaku (nunchucks)
  • Sandclubs, sandbags, slungshots (saps, blackjacks)
  • Throwing stars (shuriken)
  • Tonfas
  • Kusari-fundo (manrikis)
• Clubs and blunt weapons, such as:
  • Billy clubs, police batons, nightsticks, truncheons
  • Escrima sticks, weighted clubs, sjamboks
  • Bo/jo staffs, rattan canes (when used as striking weapons)
  • Sap hats (slap hats)
• Flamethrowers and flame guns
• Starter guns/pistols, blank guns, and similar items
• Steel-jaw animal traps (leg-hold, foot-hold, body traps)
• Concealed weapons
• Military- or law enforcement–only weapons/items

10. Food and Beverage

BettaMall prohibits the sale of food and beverage products that do not comply with safety, inspection, or import requirements.

• Meat and meat products not meeting import standards, including:
  • Horse meat
  • Meat imported from China
  • Beef/beef products imported from South Korea
  • Kaffir lime leaves from Thailand
  • Edible bird’s nests without proper permits/certifications
• Infant formula not meeting FDA requirements, such as goat’s milk formula or HIPP products
• Products containing betel nut or betel nut flavoring
• Poppy seeds not from approved brands or in pack sizes over 1 lb
• Non–cage-free eggs sold into California

11. Gambling and Lottery

The following gambling and lottery-related items are not allowed on BettaMall:

• Lottery tickets
• Coin-operated slot machines
• Slot machines that can be converted to accept coins or currency

12. Human body parts

BettaMall strictly prohibits the sale of human body parts and related items, including but not limited to:

• Blood, sperm, eggs, tissue, or organs
• Human remains, waste, and bodily fluids
• Historical grave markers or tombstones
• Native American burial items
• Artifacts taken from Native American land, federal or state land, or battlefield sites

13. Prohibited Substances, Stimulants, Narcotics, and Drug Paraphernalia

BettaMall strictly prohibits the sale of illegal drugs, addictive substances, and any related paraphernalia.

(i) Narcotics (including synthetic drugs)

• Illegal drugs, steroids, and other substances banned under applicable laws.
• Nitrous oxide (“laughing gas”), ecstasy, anesthetics, sedatives, stimulants, cannabis, hashish, and similar substances.

(ii) Chemicals or raw materials: Any chemical, ingredient, or raw material used to manufacture narcotics, stimulants, or addictive substances.

(iii) Drug paraphernalia: Devices or products intended for producing, preparing, or consuming drugs, such as glass pipes or vaporizers designed for smoking or drug use.

(iv) Cannabis-related imagery or content: Items featuring cannabis leaves, “420” symbols, or similar representations.

14. Tobacco Products

Tobacco and related smoking products, including accessories, are not allowed on BettaMall.

• Tobacco items: Cigarettes, cigars, e-cigarettes, smokeless tobacco, shisha, and pipe tobacco.
• Tobacco ingredients: Raw materials containing nicotine, vape liquids, or similar substances.
• Smoking devices & accessories: Pipes, rolling papers, cigar cutters, and electronic cigarette parts or accessories.

15.  Intrusion Devices

BettaMall prohibits the sale of devices intended for unlawful activities, covert surveillance, or signal interference.

• Lock-picking / locksmith tools
  • Automatic pick guns, jigglers, bump keys, slim-jims, tension wrenches, tubular picks, try keys.
  • Lock-breaking kits, lock-picking tool sets, tubular picks.
  • Handcuff keys, master/ignition keys.
  • Training locks intended for bypassing security (note: legitimate training devices may be reviewed with proper certification).
• Key duplication / code-reading devices
  • Key duplicators
  • Card readers, card skimmers
  • Code grabbers
  • Key decoders
  • Lock cards and lock-picking guns.
• Store theft / anti-theft bypass devices
  • Tag detachers
  • Sensor removers
  • Tools used to defeat anti-theft systems.
• Signal jamming / interference devices
  • Signal jammers/blockers (telecommunications, GPS, Wi-Fi, etc.).
  • Cable TV descramblers and similar devices.
  • Traffic signal control devices.
• Scanning / decoding devices: Radar detectors or jammers.
• Electricity fraud / tampering devices: Power-saving scam devices or tools designed to manipulate electricity meters.
• Covert surveillance / recording devices: Miniature hidden cameras or audio/video recorders, spy cameras, or any disguised recording devices.
• Catch-all: Any device, tool, or accessory that BettaMall determines is primarily intended to facilitate illegal intrusion, theft, fraud, lock bypass, or unauthorized information gathering.

16. Refrigerants: Ozone-Depleting Substances (ODS) and Alternatives

If you list products containing refrigerants on BettaMall, you must comply with all applicable federal, state, and local laws, regulations, standards, and our policies.

In the U.S., refrigerants that harm the ozone layer, known as ozone-depleting substances (ODS), are regulated by the Environmental Protection Agency (EPA) and some state authorities. Controlled refrigerants include:

• Substances classified by EPA as Class I or Class II ODS
• Any products containing Class I or II ODS
• Certain ODS substitutes, including specific hydrofluorocarbons (HFCs)

Class I/II ODS and ODS substitutes may only be sold to certified technicians under EPA programs, and bulk HFCs require EPA permits. None of these products may be sold on BettaMall, except certain exempt refrigerants such as:  CO₂ (R-744), nitrogen (R-728), and specific ODS alternatives for automotive AC in sealed containers ≤2 lb, excluding restricted HFCs

Moreover, some states may impose additional restrictions on the sale or distribution of refrigerants.

• Washington: Hydrofluorocarbon Emission Reduction law (RCW 70A.60) prohibits sales of high-GWP HFCs.
• California: HFC reduction regulations under Title 17, §§ 95371–95378
• New York: Restrictions under 6 NYCRR Part 494

17.  Offensive and Controversial Materials

Merchants must follow all applicable laws and BettaMall policies when listing products. Our policies on offensive products apply to all items, excluding books, music, videos, and DVDs.

These policies are in place to maintain a safe and respectful environment for all Buyers and Merchants while providing a broad range of products. BettaMall considers cultural sensitivities and global community standards when reviewing listings. These following products are prohibited on BettaMall: 

• Violence, Intolerance, and Hate: Products promoting or glorifying violence, hate, suicide, terrorist groups, or criminals; violent/offensive items lacking historical significance.
• Intolerance: Items encouraging discrimination based on race, religion, or sexual orientation; products containing racially offensive language.
• Human Tragedies and Disasters: Items related to natural disasters or human tragedies.
  Child Abuse and Exploitation: Products depicting child abuse or sexualized children, content with adult themes for children, or age-inappropriate items targeted at minors.

18. Warranties, service plans, contracts, and guarantees

BettaMall has not accepted new applications to sell services, warranties, or related offers yet. Therefore, these following products & services are not allowed to list on BettaMall:

• Extended service warranties
• Money-back guarantees
• Replacement or exchange plans
• Service contracts
• Buy-back guarantee programs
• Investment services
