BettaMall is committed to protecting intellectual property rights and maintaining a trusted marketplace for all users. We do not permit any listings or activities that infringe upon the intellectual property rights of others, including but not limited to copyrights, trademarks, patents, designs, and trade secrets.

We actively cooperate with rights owners, merchants, and customers to identify and remove infringing content to reduce intellectual property rights concerns. By participating in BettaMall, all users agree to respect the rights of creators, brands, and innovators.

Non-exhaustive list of trademarks

Without written authorization or permitted under our Trademark Usage Guideline, non-exhaustive list of trademarks owned by BettaMall may not be used. Unauthorized use of these marks causing confusion, affecting brand identity,… is strictly prohibited.

3rd Party Licensing Notice 

BettaMall products and services may include third-party software components under licenses. We are committed to fully complying with the obligations of these licenses, including maintaining copyright notices, acknowledging original authors, and, where required, making source code available upon request.

In the event of a conflict between the BettaMall Terms of Use and the applicable open-source license governing such software, the open-source license shall prevail with respect to that software.

BettaMall respects the rights of intellectual property owners. If you believe your intellectual property rights have been infringed on our platform, you may submit a complaint through our designated process.

IPR Complaint Mechanism

BettaMall respects the rights of intellectual property owners. If you believe your intellectual property rights have been infringed on our platform, you may submit a complaint with relevant information and supporting documents for our review. We will assess the case and take appropriate actions in accordance with our Intellectual Property Policy and applicable regulations.

Before proceeding, please ensure that you are either the rights owner or an authorized representative of the rights owner. To report an IP infringement, you must log in to your BettaMall account and complete the Infringement Report Form, specifying whether the violation concerns a trademark, copyright, patent, or other IP right.

Your report should include the following details:

  • Specific identification of the IP allegedly infringed. For trademarks, copyrights, or patents, please provide the registration number, a written description or link to the original work/product, the first date of use, and any other relevant details.
  • Type of infringement which specifies where the infringement occurs: on the product itself, its physical packaging, product images, or text descriptions displayed on BettaMall.
  • List of infringing products includes the unique product identifiers and/or URLs of the product pages. If you believe that only certain merchants are infringing (and not all merchants on the product detail page), please select the specific sellers to be reported in the Infringement Report Form.
  • Detailed list of the infringing merchants. If they are selling under your product identifier, ensure you specify the exact merchants to avoid affecting the entire product page.
    Note: A product detail page may include multiple listings or offers from different merchants, so please review carefully to avoid reporting your own offer.
  • Supporting documents or evidence that demonstrate your IP ownership and assist BettaMall in processing your complaint fairly and transparently.
  • Your contact information includes your name, phone number, address, email, and any additional contact details.

Please note that each complaint form should cover only one type of IP infringement. BettaMall will process only the specific type of complaint you selected to ensure efficient and accurate resolution.

If circumstances change after submission, you may request a retraction of your initial complaint.

After you submit your complaint, BettaMall will send a confirmation notice acknowledging receipt. We will then notify the reported party and share your contact information so both parties may communicate directly. Throughout the process, BettaMall will keep you updated on the status of your complaint.

  • If your complaint is accepted, BettaMall will remove the infringing content and take appropriate actions against the infringing party. However, we will not disclose details of any internal or non-public actions.
  • If your complaint is not accepted, the content will remain unchanged. We will not take any enforcement action on the merchants. In such cases, BettaMall will notify you of the decision and provide the reason for rejection.
